Employment tribunals are now more frequently being asked to balance <strong>competing rights under the Equality Act 2010<\/strong>, including those relating to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Gender reassignment<\/li>\n\n\n\n<li>Sex<\/li>\n\n\n\n<li>Religion or belief<\/li>\n\n\n\n<li>Disability (including trauma-related conditions)<\/li>\n<\/ul>\n\n\n\n<p>These are not abstract debates. They reflect <strong>real lived experiences, dignity, safety, and identity<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Cases Bringing National Attention<\/strong><\/p>\n\n\n\n<p>As of April 2025, two significant cases are ongoing:<\/p>\n\n\n\n<p><strong>Darlington NHS Trust<\/strong><br>A group of nurses have brought claims alleging sex discrimination and harassment linked to changing room access arrangements. Concerns raised include dignity, trauma triggers, and workplace culture.<\/p>\n\n\n\n<p><strong>NHS Fife (Scotland)<\/strong><br>A nurse has brought a claim following suspension after challenging the use of a female changing space by a trans woman. Issues raised include belief discrimination and workplace treatment.<\/p>\n\n\n\n<p>These cases highlight a critical point:<br><strong>There is no one-size-fits-all answer and the law does not expect one.<\/strong><strong><br><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>What the Law Says<\/strong><\/p>\n\n\n\n<p><strong>1. Preventative Duty on Sexual Harassment (2024 onwards)<\/strong><\/p>\n\n\n\n<p>Under the <strong>Worker Protection (Amendment of Equality Act 2010) Act 2023<\/strong>, employers must now take <strong>reasonable steps to prevent sexual harassment<\/strong>.<\/p>\n\n\n\n<p>This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Proactive risk assessments<\/li>\n\n\n\n<li>Clear policies<\/li>\n\n\n\n<li>Staff training<\/li>\n\n\n\n<li>Effective reporting systems<\/li>\n<\/ul>\n\n\n\n<p><strong>Key implication:<\/strong><br>Where changing facilities are shared or contested, employers must anticipate risks and act <strong>before harm occurs<\/strong> not after.<\/p>\n\n\n\n<p><strong>2. EHRC Guidance on Single-Sex Spaces<\/strong><\/p>\n\n\n\n<p>Guidance from the Equality and Human Rights Commission confirms:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Single-sex services <strong>can be lawful<\/strong><\/li>\n\n\n\n<li>Exclusion of trans people <strong>may be lawful<\/strong><\/li>\n\n\n\n<li>But only where it is a <strong>proportionate means of achieving a legitimate aim<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Examples of legitimate aims include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Privacy and dignity<\/li>\n\n\n\n<li>Safety<\/li>\n\n\n\n<li>Trauma-informed considerations<\/li>\n<\/ul>\n\n\n\n<p>However, decisions must be:<\/p>\n\n\n\n<p>\u2714 Evidence-based<br>\u2714 Individualised<br><strong>X<\/strong> Not based on assumptions or prejudice<strong><br><\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Understanding the Full Spectrum of Impact<\/strong><\/p>\n\n\n\n<p>A key part of lawful and inclusive practice is recognising <strong>diverse lived experiences across all groups<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Trans Experiences and Safety<\/strong><\/p>\n\n\n\n<p>It is important to acknowledge that <strong>trans individuals are not a homogenous group<\/strong>, and experiences differ significantly.<\/p>\n\n\n\n<p>For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Some individuals have legal recognition through a <strong>Gender Recognition Certificate (GRC)<\/strong> under the Gender Recognition Act 2004<\/li>\n\n\n\n<li>Some have undergone medical transition, while others have not<\/li>\n\n\n\n<li>Many face high levels of harassment, discrimination, and violence<\/li>\n<\/ul>\n\n\n\n<p>As reflected in stakeholder feedback and public commentary:<\/p>\n\n\n\n<p>Some trans individuals, including those who have undergone full gender reassignment and live permanently in their affirmed gender, express <strong>fear that exclusion from single-sex spaces could place them at risk<\/strong>, particularly if required to use facilities that do not align with their lived identity.<\/p>\n\n\n\n<p>This highlights a critical legal and ethical point:<\/p>\n\n\n\n<p><strong>Safety and dignity considerations apply to trans people as well as others.<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Women, Trauma, and Privacy<\/strong><\/p>\n\n\n\n<p>At the same time:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Many women, particularly survivors of sexual violence, may experience distress in shared or mixed-sex environments<\/li>\n\n\n\n<li>With approximately 1 in 4 women experiencing sexual violence, trauma-informed approaches are essential<\/li>\n<\/ul>\n\n\n\n<p><strong>Religion and Belief<\/strong><\/p>\n\n\n\n<p>The law also protects:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Religious beliefs relating to modesty and privacy<\/li>\n\n\n\n<li>Gender-critical beliefs (confirmed in case law such as Forstater v CGD Europe)<\/li>\n<\/ul>\n\n\n\n<p>Employers must ensure:<\/p>\n\n\n\n<p>Staff are not disadvantaged or penalised for holding lawful beliefs<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Legal Framework: Balancing Rights<\/strong><\/p>\n\n\n\n<p>Employers must navigate multiple overlapping duties:<\/p>\n\n\n\n<p><strong>Gender Reassignment<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Protected characteristic under the Equality Act<\/li>\n\n\n\n<li>Exclusion must be <strong>justified, proportionate, and evidenced<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Sex Discrimination<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Policies may unintentionally disadvantage women<\/li>\n\n\n\n<li>Requires careful justification<\/li>\n<\/ul>\n\n\n\n<p><strong>Disability<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>PTSD and trauma can meet the legal definition<\/li>\n\n\n\n<li>Requires reasonable adjustments<\/li>\n<\/ul>\n\n\n\n<p><strong>Religion or Belief<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Policies must not indirectly discriminate<\/li>\n\n\n\n<li>Must allow for dignity and accommodation<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>What Should Employers Do Now?<\/strong><\/p>\n\n\n\n<p><strong>1. Audit Facilities<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Are spaces open-plan or private?<\/li>\n\n\n\n<li>Are alternative options available (e.g. single-use spaces)?<\/li>\n\n\n\n<li>Are all options safe and equitable?<\/li>\n<\/ul>\n\n\n\n<p><strong>2. Update Policies<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Clearly outline how decisions are made<\/li>\n\n\n\n<li>Include risk assessment processes<\/li>\n\n\n\n<li>Address all forms of harassment<\/li>\n<\/ul>\n\n\n\n<p><strong>3. Engage Meaningfully<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Gather anonymous staff feedback<\/li>\n\n\n\n<li>Include voices from:\n<ul class=\"wp-block-list\">\n<li>Trans staff<\/li>\n\n\n\n<li>Women and survivors<\/li>\n\n\n\n<li>Religious groups<\/li>\n\n\n\n<li>Disabled and neurodivergent staff<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>4.
